Terms and Conditons

1. General

1.1. All orders placed with MotoHelmets are subject to these terms and conditions, which are to be read in conjunction with any terms of business outlined in our catalogue. For any queries, please contact us at hello@motohelmets.co.uk.

1.2. The catalogue does not constitute an offer to sell.

1.3. An order submitted to us is considered an offer which we may accept or decline.

1.4. Submitting an order signifies acceptance of these terms and conditions. If you do not agree to these terms, please return the goods within 48 hours.

1.5. Orders accepted by us cannot be cancelled by the buyer except with written consent and on terms that the buyer will indemnify us for any losses, including loss of profit, costs, damages, and expenses incurred.

2. Making a Purchase

2.1. Browse our online catalogue, add desired products to your basket, and proceed to checkout. Ensure all order details, including sizes and delivery address, are correct.

2.2. We accept payments via credit card. For international orders, the transaction will be converted to your currency by your credit card provider. We accept Solo, Maestro, Visa, and Mastercard. Payment details can be provided via phone, mail, or online.

2.3. Payment is processed when your order is ready to ship or upon agreement for special orders.

3. Delivery Schedule

3.1. Delivery charges are based on order value and location. See our delivery charges table [link to delivery charges]. Orders are dispatched using a signed-for service. A tracking number will be provided once dispatched.

3.2. We may not hold all items in stock due to space limitations. Key products are usually dispatched within 1 day. Items not in stock will be ordered from suppliers, and you will be informed of the estimated delivery time. You may cancel your order if the timescale is unacceptable.

4. Tax & Duty

4.1. Orders within the UK and EU include 20% VAT unless a registered VAT number is provided. Orders outside the Eurozone are VAT-exempt.

4.2. Customers outside the EU may incur additional customs and duty charges, which are their responsibility.

5. Returns Policy

5.1. We offer a 60-day return policy. Use the Collect+ free returns service for orders over £50 in the UK. For other orders, customers are responsible for return shipping.

5.2. A restocking fee may apply for goods returned in inappropriate condition.

5.3. Returns or refunds may be refused for goods purchased for commercial use or by agencies. Such goods will be returned to the original purchaser.

6. Title & Risk

6.1. Ownership of goods remains with us until full payment is received. Goods should be kept separate from other items and properly insured until ownership transfers.

6.2. The buyer holds goods in trust for us and must take proper care of them until payment is complete.

6.3. Risk transfers to the buyer upon delivery.

6.4. We reserve the right to reclaim goods if payment is not made, with a 48-hour notice period.

7. Force Majeure

7.1. We are not liable for delays or non-delivery due to events beyond our control, including natural disasters, government actions, strikes, or other contingencies.

7.2. If goods become unfit for delivery due to such events, the contract is deemed discharged without liability.

8. Price

8.1. Goods are sold at the prices current at the time of order.

8.2. VAT is added to the price where applicable.

8.3. Prices may be adjusted due to changes in supply costs or external factors.

8.4. Prices are subject to change without notice.

9. Complaints

9.1. Submit all complaints in writing. If a product fault is verified, we may consult the supplier before offering repair or replacement.

10. Terms of Payment

10.1. Invoices are net and accounts are overdue after 30 days from the invoice date.

10.2. Interest of 2% per month will be charged on overdue accounts.

10.3. Deliveries may be withheld until all outstanding payments are received.

10.4. Returned cheques incur bank charges and a handling fee, to be reimbursed by the buyer.

11. Damage, Delay, or Loss in Transit

11.1. Report any damage or loss within 48 hours.

11.2. Inspect goods upon receipt and note any damage as “damaged in transit” when signing.

11.3. Notify us immediately by email.

12. Availability

12.1. Orders are subject to the availability of goods.

12.2. We will inform you of the estimated delivery time for unavailable items.

12.3. If the estimated time is unacceptable, you may cancel the order.

12.4. If no suitable product is available, the contract is cancelled without liability, and any payments will be credited.

13. Liability

13.1. We warrant that goods meet the specified contract terms and accept liability for breaches.

13.2. We will either replace defective goods or refund payments for such goods, which is the extent of our obligation.

13.3. We exclude all other express or implied warranties not stated in these conditions.

13.4. Our liability ceases if payment is not made by the due date.

13.5. Prices are based on this liability limitation.

13.6. The buyer acknowledges the fairness of this liability limitation and should insure against excluded risks.

13.7. Information provided is for general guidance only and does not constitute a warranty.

14. Arbitration

14.1. Disputes arising from the contract may be referred to arbitration under relevant Arbitration Acts.

15. Law & Interpretation

15.1. These conditions and contracts are governed by English law.

15.2. Headings are for convenience only and do not affect the conditions.

15.3. If any provision is unenforceable or invalid, the remaining provisions remain effective.

17. Discount & Voucher Codes

17.1. Only one discount or voucher code can be used per transaction.

17.2. Discount codes are subject to fair use, and abuse will void the codes.

17.3. We may suspend or remove discount codes without notice.
